1. Scope of Application

These General Terms and Conditions (GTC) apply to the use of the Femify PWA (Progressive Web App) and all related services.

2. Subject Matter of the Contract

2.1 Description

Femify is a fitness tracking app for women that offers the following features:

  • Workout planning and tracking
  • Weight and progress tracking
  • Cycle tracking (optional)
  • AI-based training advice and movement analysis
  • Connect feature (social functions, optional)
  • Flow videos (training videos)
  • Academy (editorial articles and information on training, nutrition, and well-being)
  • Challenges

2.2 Femify One Subscription

Use of the app requires a Femify One subscription. Various subscription plans are available and can be selected on www.femify.de.

Current subscription plans (as of March 2026):

  • Monthly subscription: Monthly payment, cancellable monthly
  • Annual subscription (monthly payment): Monthly payment over 12 months, cancellable monthly
  • Annual subscription (one-time payment): One-time payment for 12 months

Note: Prices may vary. Current prices can be found on the landing page. Discount codes and special offers may affect prices. All prices include statutory value-added tax (VAT).

Payment methods:

  • Stripe: Credit card, debit card, SEPA direct debit, and other available payment methods
  • PayPal: PayPal account

The available payment methods may vary depending on the subscription plan and are displayed during the checkout process.

3. Conclusion of Contract

3.1 Purchase Process

  1. The purchase takes place on www.femify.de
  2. You select a subscription plan
  3. Optional: You enter a discount code
  4. You are redirected to Stripe Checkout or PayPal
  5. After successful payment, you will receive an email with instructions for activation
  6. You register in the app (app.femify.de) using the same email address
  7. Your Femify One subscription is activated automatically

3.2 Account Creation and Access

Registration:

  • You must create an account to use the app
  • You are obliged to provide truthful information
  • One account per person (no multiple registrations)
  • You are responsible for keeping your login credentials confidential
  • You must inform us immediately if your account has been compromised

Access:

  • Access to the app is only possible with an active Femify One subscription
  • We reserve the right to suspend or delete accounts in the event of misuse
  • In the event of a breach of these GTC, access may be suspended without prior notice

Age:

  • The app is intended for users of legal age
  • Minors require the consent of a legal guardian

4. Price, Payment, and Subscription

4.1 Price

  • All prices include statutory value-added tax (VAT)
  • Prices may vary (special offers, discount codes, etc.)
  • Current prices are displayed during the checkout process
  • Prices may be adjusted at any time (see § 13 Amendments to the GTC)

4.2 Payment Methods

Stripe:

  • Credit card, debit card, SEPA direct debit
  • Additional payment methods may be available depending on your region
  • The available payment methods are displayed during the checkout process

PayPal:

  • PayPal account
  • Available depending on the subscription plan

4.3 Payment Schedule and Billing

Monthly subscription:

  • Payment monthly in advance
  • Automatic renewal every month
  • Cancellable at any time effective at the end of the current billing period

Annual subscription (monthly payment):

  • Payment monthly over 12 months
  • Automatic renewal after 12 months (monthly)
  • Cancellable at any time effective at the end of the current billing period

Annual subscription (one-time payment):

  • One-time payment for 12 months
  • Automatic renewal after 12 months (renewed one-time payment)
  • Cancellation possible: The subscription continues until the end of the term and is not renewed thereafter

4.4 Due Date

Payment is due immediately upon conclusion of the contract. For recurring subscriptions, the next payment is made automatically on the same day of the following month or year, respectively.

4.5 Payment Default

In the event of payment default, we reserve the right to:

  • Temporarily suspend access
  • Terminate the subscription
  • Charge reminder fees (to the extent permitted by law)

Grace period:

  • In the event of payment default, we grant a short grace period
  • After the grace period expires, access will be suspended

5. Cancellation and Termination of Contract

5.1 Cancellation by You

Monthly subscription:

  • Cancellable at any time effective at the end of the current billing period
  • Cancellation via the “Cancel contract” link in the footer of our website, via the Stripe Customer Portal or by email to support@femify.de
  • The cancellation must be made no later than 24 hours before the end of the current billing period

Annual subscription (monthly payment):

  • Cancellable at any time effective at the end of the current billing period
  • Cancellation via the “Cancel contract” link in the footer of our website, via the Stripe Customer Portal or by email to support@femify.de
  • The cancellation must be made no later than 24 hours before the end of the current billing period

Annual subscription (one-time payment):

  • Cancellation possible: The subscription continues until the end of the term and is not renewed thereafter
  • After expiry of the 12 months, automatic renewal (renewed one-time payment) unless cancelled
  • Cancellation of the renewal is possible (before expiry of the 12 months)

5.2 Termination by Us

We may terminate the subscription for cause in the event of:

  • Breach of these GTC
  • Payment default (after expiry of the grace period)
  • Misuse of the app
  • Violation of statutory provisions

5.3 Consequences of Cancellation

Upon cancellation:

  • Access ends at the end of the paid period
  • All data remains stored until your account is deleted
  • You can delete your account at any time (see Privacy Policy)
  • No refund: In the case of partial use, there is no entitlement to a pro-rata refund (to the extent permitted by law)

Refund in case of early cancellation: If an annual subscription that has been renewed automatically and for which an advance payment was made is cancelled, a pro-rata refund of payments already made for services not yet rendered will be issued. The calculation is made pro rata based on the remaining months until the end of the billing period.

Upon termination of the contract:

  • Access to the app ends when the contract ends
  • All stored data may be deleted (see Privacy Policy)

6. Right of Withdrawal

6.1 Right of Withdrawal for Femify One

You may withdraw from your Femify One contract within 14 days of conclusion of the contract without giving any reason. The right of withdrawal applies for the full period, even if you already use the app during this time. No early expiry of the right of withdrawal pursuant to Section 356(5) of the German Civil Code (BGB) is agreed.

In the event of withdrawal, we will reimburse all payments you have made for Femify One. Details can be found in Section 6.2.

7. Availability and Downtime

7.1 Availability

  • We strive to ensure high availability of the app
  • No 100% availability: Uninterrupted availability of the app is not guaranteed
  • Maintenance work, security updates, or technical malfunctions may lead to temporary restrictions
  • We are not liable for outages caused by force majeure, technical problems of third parties, or hosting outages

7.2 Maintenance Work

  • Maintenance work may lead to temporary outages
  • We strive to carry out maintenance work outside peak usage hours
  • Advance notice is not always possible

7.3 External Services and APIs

  • The app uses external services (hosting, APIs, etc.)
  • We are not liable for outages or malfunctions of these external services
  • In the event of outages of external services, the functionality of the app may be restricted

8. Features and Scope of Functionality

8.1 Feature Changes

  • We reserve the right to adjust, expand, or remove features
  • The core service (fitness tracking, workout planning) remains available
  • No entitlement to specific features: You have no entitlement to specific features or functions
  • Features may be changed, expanded, or removed at any time
  • AI features: The use of AI-based features (training advice, movement analysis) is provided via a credits system. The available credits are included in the subscription and may be limited.

8.2 Core Service

The core service comprises:

  • Workout planning and tracking
  • Weight and progress tracking
  • Basic functions of the app

Additional features (AI advice, Connect, Flow videos, etc.) may be changed or removed.

9. Terms of Use

9.1 Permitted Use

You may:

  • Use the app for personal, non-commercial purposes
  • Install the app on multiple devices (with the same account)
  • Save content for personal purposes

9.2 Prohibited Use

You may not:

  • Use the app for commercial purposes (without our written consent)
  • Engage in reverse engineering
  • Copy, modify, or distribute the app or parts thereof
  • Use automated systems (bots, scrapers) or extract data from the app by automated means
  • Use the app for illegal purposes
  • Harass, threaten, or abuse other users (Connect feature)
  • Spread false or misleading information
  • Pass on the app or its content to third parties

9.3 Account Security

  • You are responsible for keeping your login credentials confidential
  • You must inform us immediately if your account has been compromised
  • We are not liable for damages resulting from unauthorized access to your account
  • If misuse is suspected, we reserve the right to suspend the account

9.4 Suspension in Case of Misuse

In the event of a breach of these GTC, we reserve the right to:

  • Temporarily or permanently suspend the account
  • Terminate the subscription
  • Take legal action

10. Disclaimer of Liability

10.1 Availability

  • We are not liable for outages caused by force majeure or technical problems of third parties
  • We are not liable for outages caused by hosting failures or API failures of external services
  • No liability for data loss caused by technical malfunctions

10.2 Content

  • We assume no liability for the accuracy, completeness, or currency of the content
  • Training recommendations do not constitute medical advice
  • You use the app at your own risk

10.3 Health and Consequences of Training

  • The app is not a medical or therapeutic application
  • Training recommendations do not replace medical advice
  • In case of health problems, please consult a physician
  • No liability for consequences of training: We are not liable for health damage, injuries, or other consequences resulting from the use of the app or from following training recommendations
  • AI-based recommendations: We strive in good faith to provide the best possible answers and recommendations. Nevertheless, with AI-supported functions there is a residual risk that content may be incomplete or inaccurate. This risk lies within the scope of what is technically possible and is accepted by you when using the AI features.

10.4 External Content

  • We assume no liability for external content (e.g., content shared in the Connect feature)
  • We assume no liability for third-party content

10.5 Limitation of Liability

Permissible limitation of liability:

  • Our liability is limited to intent and gross negligence
  • In cases of slight negligence, we are only liable for the breach of material contractual obligations
  • Liability for damages is limited to typically foreseeable damages
  • Excluded: Liability for indirect damages, consequential damages, lost profits, or data loss (to the extent permitted by law)

Material contractual obligations:

  • Provision of the app and its core functions
  • Data protection and data security

10.6 Nutrition Information

The nutritional information, calorie data, and nutrition analyses provided in the Femify app are for informational purposes only and do not constitute medical advice, diagnosis, or treatment recommendations.

  • The nutritional data comes from various external sources and may contain inaccuracies despite careful review
  • For health-related questions, eating disorders, allergies, or special dietary needs, please consult a physician or qualified nutritionist
  • Use of the nutrition feature is at your own risk

11. Support

11.1 Support Channels

11.2 Support Rules

  • Support is provided by email only
  • No guaranteed response time: We strive to respond quickly but do not guarantee any specific response time
  • Support language: German
  • Changes to the contact channels are possible and will be announced

11.3 Scope of Support

  • Support covers technical questions about using the app
  • Support covers questions about subscriptions and payment
  • Not included: Medical advice, training advice (outside the app's functions)

12. Data Protection

Your personal data is processed in accordance with our Privacy Policy: our Privacy Policy

13. Amendments to the GTC

13.1 Adjustments

  • We reserve the right to amend these GTC
  • Amendments may be made in response to changes in the legal situation, technical changes, or to improve the GTC

13.2 Duty to Inform

  • You will be notified of amendments by email
  • The amended GTC will be published at www.femify.de/AGB
  • You will be given a period of 4 weeks to object to the amendments

13.3 Right to Object

Objection:

  • Within 4 weeks of receiving the notification of amendment
  • By email to: support@femify.de
  • In the event of an objection, the subscription ends at the end of the current billing period

13.4 Continued Use as Acceptance

  • If you do not object to the amendments, they are deemed accepted
  • Continued use of the app after expiry of the objection period is deemed acceptance of the amended GTC

14. Copyright

14.1 Our Rights

  • All content (texts, images, videos, software) is protected by copyright
  • Use is permitted only within the scope of these GTC
  • Any further use requires our written consent

14.2 Your Rights

  • You retain all rights to your own content (workouts, data, etc.)
  • By using the app, you grant us a license to store and process your data (see Privacy Policy)

15. Final Provisions

15.1 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

15.2 Place of Jurisdiction

The place of jurisdiction is Köln (Cologne), provided you are a merchant, a legal entity under public law, or a special fund under public law.

15.3 Severability Clause

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
